Overview

We are seeking a highly skilled and experienced Healthcare Attorney to join our legal team. This position will focus on healthcare litigation, managed care contracting, No Surprises Act process and litigation, compliance guidance on privacy matters, and provide some government affairs support. The ideal candidate will have a deep understanding of healthcare law with expertise in litigation and preferred experience in managed care agreements, as well as with compliance in privacy matters such as HIPAA. This role will also involve advising on regulatory issues and government affairs impacting the healthcare industry.

Key Responsibilities:

  1. Healthcare Litigation:
    • Supervise litigation matters related to business operations, including but not limited to, disputes arising from managed care contracts, payer-provider relationships, and regulatory enforcement actions.
    • Manage complex cases, from pre-litigation through trial and appeals, providing strategic guidance and legal advice.
    • Work closely with external counsel, regulatory bodies, and internal teams to achieve favorable outcomes.
  2. Managed Care Contracting:
    • Draft, negotiate, and review managed care contracts between healthcare providers and payers, ensuring compliance with federal and state regulations.
    • Advise on contractual disputes, including interpretation of terms, obligations, and enforcement issues.
    • Provide strategic guidance on the development and management of managed care agreements and relationships.
  3. Compliance and Privacy Guidance:
    • Advise clients on compliance with federal and state healthcare regulations, including the Health Insurance Portability and Accountability Act (HIPAA), data privacy laws, and related regulatory requirements.
    • Provide ongoing counsel regarding the privacy and security of health information, risk management, and internal policy development.
    • Respond to privacy incidents, investigations, and regulatory inquiries, providing solutions and recommendations.
  4. Government Affairs:
    • Stay up-to-date on legislative and regulatory changes that impact the healthcare industry, including Medicare, Medicaid, and other federal and state healthcare programs.
    • Collaborate with government affairs teams and advocacy groups on healthcare policy matters, regulatory changes, and legislative actions.
    • Assist in the preparation of comments, testimony, and other communications to government entities regarding proposed healthcare laws or regulations.
  5. Client Counseling:
    • Provide strategic, proactive legal advice to clients on a variety of issues, including payer-provider relationships, regulatory compliance, and risk management.
    • Offer practical solutions to complex legal and regulatory challenges, ensuring that clients' business objectives are met in compliance with healthcare laws.
  6. Training and Education:
    • Conduct training sessions for clients or internal teams on healthcare regulations, litigation risks, and compliance matters.
    • Stay current on developments in healthcare law and policy, sharing knowledge across the organization.

Qualifications:

  • Juris Doctor (JD) degree from an accredited law school.
  • Active Bar membership in Texas.
  • 5-10 years of experience in healthcare law, with a focus on litigation, managed care contracting, privacy compliance (HIPAA), and government affairs.
  • Strong knowledge of federal and state healthcare regulations, including healthcare fraud and abuse laws, insurance regulations, and privacy laws.
  • Experience representing healthcare clients in litigation, particularly in managed care and revenue cycle matters.
  • Familiarity with government healthcare programs (Medicare, Medicaid) and healthcare policy.
  • Excellent communication, negotiation, and analytical skills.
  • Ability to work independently and as part of a collaborative team.

Preferred Skills:

  • In-house legal experience with a healthcare provider, payer, or managed care organization.
  • Ability to draft and negotiate managed care contracts and navigate complex healthcare issues.
  • Experience with state and federal government relations, lobbying, or regulatory affairs.
  • Knowledge of emerging trends in healthcare technology and privacy law, including data security issues.
