$131,060.80 - $218,441.60 Shift: Day The Legal Counsel Risk & Litigation is accountable to support the Vice President, Chief Risk Officer with litigation and financial risk management at CNHS. In this role, the Legal Counsel is expected to coordinate various activities related to management of all litigation at CNMC. Functional accountabilities also include event investigations as well as maintaining claims data and analytics that report on litigation operations. The position requires exceptional communication and critical thinking skills, as well as attention to detail, resourcefulness, and a commitment to process improvement.

Minimum Education
Juris Doctorate (J.D.) (Required)

Required Licenses and Certifications
DC Bar preferred (Preferred)

Functional Accountabilities
Discovery and Litigation Process

  • Respond to litigation discovery requests from outside counsel including conduction of email archive searches and coordinating with other CNMC departments to collect information to respond to discovery.
  • Manage subpoenas that are served on CNMC and or CNMC employees.
  • Process all 90 day notices and complaints.
  • Set up depositions of CNMC personnel.
  • Provide initial analysis of new lawsuits to CRO upon assignment.
  • Provide initial review and analysis of medical records to CRO upon assignment.

Risk Management

  • Take risk management reports and triage appropriately based on analysis of facts.
  • Staff internal investigations into risk management events as needed.
  • Work with Risk Managers to investigate and handle visitor injury claims.
  • Review consent paperwork presented by clinical staff for sufficiency and escalate consent authority questions to Director of RM
  • Cover risk on-call yearly schedule
  • Advise Risk Managers as needed.
  • Manage business risk event investigations and risk event RCA/ACA
  • Staff Enterprise Risk Management workgroup.

Manage Litigation Committee Meetings

  • PRC meetings: schedule meetings, prepare materials, schedule and attend prep meeting with CRO. Manage all day to day activities associated with PRC meetings.
  • CRC meetings: schedule meetings, prepare materials, schedule and attend prep meeting with CRO. Manage all day to day activities associated with CRC meetings.
  • Prepare monthly litigation grid for Legal Affairs meetings. Prepare other reports for Legal Affairs meetings as assigned

Manage Filing, Data Entry and Report Generation for Claims

  • Ensure all incident reports are entered into the system in a timely manner and that LAFs are prepared as needed.
  • Timely report any serious or potentially compensable claim to Risk Manager.
  • Maintain loss run.
  • Maintain litigation and claims files in good order
  • Maintain settlement and litigation contract document in good order
  • Review correspondence from outside counsel and maintain electronic filings of litigation reports.
  • Enter claims information into electronic claims system and prepare reports as requested.

Employment Litigation Claims and Loss Run, Worker's Compensation

  • Manage all employment litigation claims and employment loss run.
  • Prepare draft position statements for CRO review.
  • Attend mediations with CRO.
  • Coordinate with outside counsel as directed.
  • Interface with Human Resources Department to investigate, manage and respond to all employment law claims.
  • Report employment matters to insurance as directed by CRO.
  • Oversee Worker's Compensation function and directly supervise Worker's Compensation Coordinator.
  • Manage employee safety issues.

The disclosed salary range includes the minimum and maximum rates within which Children's National believes an individual's base pay rate will fall for this position. It is not typical for an individual to be hired at or near the maximum of the pay range. The exact pay rate for this position will be based on a variety of factors in alignment with the Children's National compensation philosophy. These factors are legitimate and non-discriminatory including, but not limited to, the current market conditions; organizational needs; the individual's combination of prior work experience, level of education, knowledge, skills, and other qualifications. Children's National is committed to providing a fair and competitive total rewards package to each of our employees. This base salary range does not include our comprehensive benefits package or any additional compensation for which this position may be eligible.
